GetStamp Terms of Service

Agreement to these Terms

These Terms govern access to and use of GetStamp’s website, merchant dashboard, digital loyalty cards, QR features, communications, and related services.

By creating an account, using the Service, or accepting these Terms, you agree to them. If you use GetStamp for a business, you represent that you have authority to bind that business.

Eligibility and accounts

• Protect account credentials and devices
• Accept responsibility for activity performed through the account
• Give staff only the access they need
• Keep business, account, and billing information current
• Promptly report suspected unauthorized access

Accounts may not be shared between unrelated people or used to impersonate another person or business.

Merchant and staff roles

A merchant owner controls the business workspace, branches, campaigns, employees, customers, and subscription.

Owners are responsible for staff invitations, permissions, and actions. GetStamp may rely on instructions submitted through authenticated owner or staff accounts.

Customer loyalty programs

Merchants independently create, offer, and fulfill loyalty campaigns. Merchants are responsible for:

• Campaign terms, eligibility, stamp requirements, expiration, and availability
• Products, services, discounts, and rewards offered
• Honoring valid rewards and resolving customer disputes
• Accurate and lawful advertising and promotions
• Training staff and correcting improper stamp or redemption activity

GetStamp supplies record-keeping software and is not the seller or provider of merchant goods or rewards.

Customer data and privacy

Merchants must collect and use customer information lawfully, provide required notices, obtain consent where required, respond to rights requests, and limit access to authorized staff.

Plans and feature limits

• Free

  Up to 25 active customers, 1 branch, 1 campaign, and 1 staff account

• Growth

  Additional branches, staff, campaigns, analytics, and marketing tools as shown on the pricing page

• Pro

  Advanced dashboards, reports, and expanded usage as shown on the pricing page

• Enterprise

  Custom features, limits, pricing, and contract terms

Plan features, fair-use limits, and prices may change. Attempting to evade limits through duplicate accounts or records may result in restriction or suspension.

Paid subscriptions and billing

• Checkout will state price, currency, billing interval, taxes, renewal terms, and payment method.
• Paid subscriptions renew for the selected interval unless checkout states otherwise.
• The merchant authorizes the payment provider to charge applicable fees and taxes.
• Failed payment may result in a grace period, downgrade, restriction, or suspension.
• Cancellation normally takes effect at the end of the current paid period.
• Paid fees are non-refundable except where required by law or expressly agreed.

GetStamp does not directly store full payment-card details.

Marketing and email

• Have a lawful basis and required consent
• Identify the sending business
• Provide accurate, non-deceptive content
• Include and honor unsubscribe requests
• Comply with privacy, anti-spam, advertising, and consumer-protection law

GetStamp may limit or suspend campaigns causing excessive complaints, bounces, abuse reports, or legal risk.

Acceptable use

Availability and changes

Availability is not guaranteed. Maintenance, provider outages, connectivity, browser limitations, security events, or force majeure may interrupt access.

GetStamp may add, change, suspend, or discontinue features and will provide notice of material changes to paid functionality when practical.

Intellectual property

GetStamp and its licensors own the Service, software, branding, designs, and documentation.

Merchants receive a limited, non-exclusive, non-transferable, revocable right to use the Service for internal business operations during their plan.

Merchants retain ownership of lawful content and grant GetStamp the rights needed to host, process, transmit, and display it to provide the Service.

Suspension and termination

• Violation of these Terms
• Unpaid fees
• Security, legal, deliverability, or operational risk
• A competent authority’s requirement
• Reasonably suspected fraudulent or abusive conduct

Where reasonable, GetStamp will provide notice and an opportunity to resolve the issue. Immediate action may be taken for urgent risk.

Disclaimers

To the maximum extent permitted by law, the Service is provided as is and as available.

GetStamp does not guarantee increased retention, revenue, campaign performance, email delivery, customer participation, or reward redemption.

Rights and warranties that cannot legally be excluded remain unaffected.

Limitation of liability

To the maximum extent permitted by law, GetStamp is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, data, or opportunity.

Aggregate liability will not exceed the greater of fees paid during the 12 months before the claim or PHP 1,000 for a Free-plan merchant.

Limits do not apply where liability cannot legally be limited.

Indemnity

• Merchant campaigns, goods, services, or rewards
• Merchant collection or use of customer information
• Unlawful marketing or failure to honor unsubscribe requests
• Merchant-submitted content
• Merchant or staff violation of these Terms or applicable law

Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines.

The parties will first attempt good-faith informal resolution. Unresolved disputes will be submitted to courts in Manila, unless law requires another venue.

Changes to these Terms

GetStamp may update these Terms, update the Last updated date, and provide reasonable notice of material changes. Continued use after the effective date constitutes acceptance where permitted by law.

General terms

• These Terms, the Privacy Policy, and any order form form the complete agreement.
• A specific signed agreement controls if it conflicts with these Terms.
• Failure to enforce a provision is not a waiver.
• Invalid provisions do not affect the remainder.
• Assignment requires GetStamp consent, except GetStamp may assign during restructuring or business transfer.
• Headings are for convenience only.
